Terms of Service

Terms and conditions governing access to and use of the GLIA platform (useglia.app) and the informational website (useglia.com), in accordance with applicable Spanish and European legislation.

Please read carefully: Using the GLIA platform implies full acceptance of these Terms of Service. If you do not agree with any of the terms, please do not use the service. If you have any questions, contact us at hola@useglia.com.

1. Service provider identification

GLIA — Synapse Ecosystem operates as a pre-incorporation project under the supervision of Hubbik (UOC Entrepreneurship Hub). During this period, contractual responsibility rests with the named individual.

2. Scope and subject matter

These Terms of Service govern access, registration and use of the GLIA platform available at useglia.app (the "Platform" or "Service"), as well as the informational website at useglia.com.

These terms apply to all user profiles: students, families, education professionals (psychologists, educational psychologists, advisors) and schools.

Use of the Service implies full acceptance of these terms, as well as the Privacy Policy and the Cookie Policy.

3. Access requirements and registration

Access to the Platform requires creating an account with accurate and up-to-date information. Users are responsible for maintaining the confidentiality of their credentials and for any activity carried out from their account.

Creating accounts on behalf of third parties without their consent, sharing login credentials between different individuals, and creating accounts with false or impersonated identities are all prohibited.

4. Minors

GLIA provides services partly directed at minors in an educational context. The following rules apply:

GLIA does not request or process special categories of data (clinical diagnoses, health data in the strict sense) through the Platform. The cognitive profile built by GLIA is based on behavioural and usage observations, not medical data. Use of GLIA does not replace evaluation or intervention by mental health professionals under any circumstances.

5. Service description

GLIA is the first longitudinal cognitive memory for students. The Platform offers, among other features:

Current prices are published on the Platform before completing the purchase process. All prices include applicable VAT. GLIA reserves the right to modify its pricing with a minimum of 30 days' prior notice, with no retroactive effect on periods already paid.

Payments are processed through secure payment providers. GLIA does not store bank card details.

7. Free trial period

GLIA offers a 15-day free trial without requiring payment details. During this period, full access to the Family plan is provided.

At the end of the trial period, access automatically reverts to the free plan with limited features, unless the user expressly subscribes to a paid plan. No automatic charges will be made at the end of the trial without prior consent.

8. User obligations and acceptable use

Users agree to use the Service in accordance with the law, these Terms and good faith. The following are expressly prohibited:

Breach of these obligations may result in immediate account suspension or termination, without prejudice to any legal action that may follow.

9. User-generated content

Users are solely responsible for the data and information they enter into the Platform (check-in responses, notes, comments). By entering content, users declare that they hold the necessary rights and that the content does not infringe third-party rights.

GLIA does not use content entered by individual users to train third-party artificial intelligence models, nor for purposes other than providing the Service itself.

10. Intellectual property

All elements of the Platform — the GLIA trade name and brand, design, source code, system architecture, cognitive profile methodology, interfaces, texts, graphics and all other content — are owned by GLIA — Synapse Ecosystem or used under licence. They are protected by Spanish and international intellectual and industrial property law.

Access to the Service does not grant the user any ownership rights over these elements. Reproduction, distribution, public communication or transformation without express prior written authorisation is prohibited.

Users retain ownership of the data they enter into the Platform. GLIA uses it solely to provide the Service and improve the user experience, in accordance with the Privacy Policy.

11. Privacy and data protection

The processing of users' personal data is governed by the Privacy Policy, in accordance with the GDPR and Spanish Organic Law 3/2018 (LOPDGDD).

In the context of schools, GLIA acts as a data processor for student data, with the school acting as data controller. This role is formalised in a Data Processing Agreement (DPA) signed with each school.

Special protection for minors' data: emotional regulation data, Panic Mode data and student wellbeing data are strictly personal. Teachers only access aggregated and anonymised group data. No teacher accesses individual sensitive data of any student.

12. Service availability and quality

GLIA aims to keep the Platform continuously available, but does not guarantee uninterrupted availability. Interruptions may occur due to maintenance, updates or causes beyond our control (force majeure, third-party infrastructure failures).

For planned interruptions of significant duration, users will be notified in advance via the Platform or by email.

Panic Mode and emergency support features are designated as critical functions and are not restricted under any plan, including the free plan.

13. Changes to the service and terms

GLIA reserves the right to amend these Terms of Service. Material changes will be communicated to users with a minimum of 30 days' notice via a notice on the Platform and by email to the registered address.

If the user continues to use the Service after the new terms take effect, they will be deemed to have accepted them. Otherwise, the user may cancel their account before the effective date without penalty.

14. Account suspension and cancellation

By the user: users may cancel their account at any time via the Platform settings or by writing to hola@useglia.com. Cancellation does not entitle the user to a refund of amounts already paid for periods in progress, except as provided by law for the right of withdrawal.

Right of withdrawal: users who subscribe to a paid plan have 14 calendar days from the date of subscription to exercise their right of withdrawal at no cost, unless they have made effective use of the service during that period with express consent.

For breach: GLIA may suspend or terminate access immediately in the event of fraudulent use, material breach of these terms or repeated non-payment, with notice to the user.

Data portability: after cancellation, users may request an export of their data in a structured format within 30 days by writing to hola@useglia.com.

15. Limitation of liability

GLIA shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the Service, including data loss, to the extent permitted by applicable law.

GLIA does not provide clinical or mental health diagnostic services. The cognitive profile generated by the Platform is for guidance and educational purposes only. It must not be used as the basis for medical or psychological diagnoses, and does not replace the intervention of healthcare professionals under any circumstances. GLIA disclaims any liability arising from improper use of the Service for such purposes.

GLIA's total liability under these terms shall not exceed the amount paid by the user during the 12 months prior to the event giving rise to the claim.

16. Applicable law and dispute resolution

These Terms of Service are governed by Spanish law. For any dispute, the parties agree to submit to the Courts and Tribunals of Barcelona, Spain, expressly waiving any other jurisdiction that may apply, unless mandatory consumer protection law establishes a different jurisdiction in favour of the user.
